In the 1970’s, California led the nation in adopting a very robust set of tort reforms in the medical malpractice area. One of these reforms was a $250,000 cap on non-economic damages. This cap has remained in place for over thirty years, without any adjustment for inflation. This cap means that plaintiffs in a given case cannot, collectively or individually, recover more than $250,000 for intangible injuries like pain and suffering and loss of companionship.

According to CoreLogic, Inc., 30 percent of the homeowners in California are “underwater” – meaning that they owe more in mortgage debt than their home is worth.
