Since the new EPA rule this year regarding Lead in homes built prior to 1978, all work must be performed by a Certified Lead Contractor. This new law yields expensive burdens on certified contractors in the handling of homes that all have lead paint and lead soider on the plumbing pipes. There is a new rising fear that the value of these homes will create depreciation in value due to this new legal burden. And who wants to live in a home where their kids could come in contact with lead poisoning? Additionally, would you hire a contractor who is not qualified to handle these materials?
Currently the new fine for working on pre-1978 homes is $37,000. Yes, thirty-seven thousand dollars for the contractor to perform this work without being certified. There are specific procedures for certified contractors to follow when working in these homes. These procedures were set up by the Environmental Protection Agency. These procedures are to protect homeowners and workers from contracting lead poisoning.
With the current economic state we are all experiencing; this law does not help the appreciating value of homes and will soon impact the Real Estate industry. New disclosures are soon to follow. With these disclosures, a fall-out of new escrows for homes sales built prior to 1978 will occur.
What is the solution? Repeal the law. Not likely. Strip the house down to the studs like I just did on our 1967 home. Not too practical for most home owners. Live with the lead. This is probably the choice of most. Don’t purchase a home built prior to 1978, yes this will happen in some cases. For more information, you can contact the following associations:
