The Importance of a Qualified Attorney
Nearly 20 bills relating to trusts, estates, Medi-Cal, elder law, and probate became law this year. We also had significant changes to our estate tax laws on the federal level. The laws keep changing, becoming more complicated. It is very important to seek legal advice from an attorney well qualified and experienced in these areas.
Our clients typically need assistance in the area of Estate Planning, after-death administration, and protecting asset when an elderly parent requires long-term care. I often become frustrated when a person seeks direction and planning from our office, but has previously relied on improper advice given by a family friend, neighbor, or even a medical professional. The wrong advice can be very costly in terms of tax liability, court costs, and penalty periods for Medi-Cal eligibility, and often requires probate court intrusion. Often times, the actions taken cannot be undone, and I wish they had consulted with an attorney before taking the wrong actions. Other times, I can fix the mistakes made, but at a higher cost than if proper advice was obtained in the first place.
It is important to understand that there is no substitute for qualified legal advice – it is well worth the investment and the peace of mind for you and your family. Mistakes can be extremely costly, and sometimes irrevocable. Do the right thing the first time, and consult with a qualified attorney who keeps abreast of all the constant changes in the law.
