Too Busy / Too Late – The McNamara Law Firm
A very nice woman (“Betty”) had an appointment with me recently. Her dear friend had passed, and Betty was named as the trustee of her friend’s trust. Betty was sole beneficiary, and her friend’s assets, including the home, were transferred easily to Betty without the probate court. The process was fast, simple, and inexpensive. I urged Betty to have an estate plan of her own. I explained that without proper legal documents, no one had legal authorization to make medical decisions if she was unable to do so, or act as power of attorney if needed. I also explained the probate process if Betty passed away, and how her assets would be subject to this lengthy and expensive process if she failed to get a trust in place.
Betty understood, and made an appointment with me. However, she cancelled due to her busy schedule. Another was set. She cancelled again. I urged Betty to give this her immediate attention, because one’s health can quickly take a turn no matter how young or old.
We received a call from Betty, who was now in the hospital. She understood when we explained that we cannot make hospital visits. She returned home, but wanted to wait until she was able to drive to have her estate plan prepared. She did not like Facetime or Zoom.
Within two weeks, we received word that Betty had passed away. Unfortunately, her estate will need to go through the probate process. Her recently deceased dear friend took the time to have a trust prepared, making it easy for Betty. However, Betty did not. I am sure Betty’s heirs wish she found the time to keep her appointment.
