(Save Prop. 13) The Local Taxpayer Protection Act – Professional Tax Services
“Save Prop. 13,” formally known as the Local Taxpayer Protection Act, is a proposed amendment to the California Constitution that has qualified for the November 2026 ballot. It is widely viewed as one of the most consequential tax-related initiatives in California in recent years.
The measure seeks to limit the ability of local governments to impose or increase certain taxes—particularly through voter-approved ballot measures. Supporters argue that the original intent of Proposition 13 (passed in 1978) was to protect taxpayers from excessive and easily enacted tax increases. They contend that court rulings over time have weakened these protections, allowing local governments to use ballot strategies and legal interpretations to raise taxes more easily than voters originally intended. Save Prop. 13 is designed to restore what proponents see as the initiative’s original safeguards.
Opponents, however, warn that the measure could significantly restrict funding for essential public services. They argue that limiting local revenue options may impact housing programs, infrastructure projects, public safety, and services addressing homelessness. Reduced flexibility in raising funds, critics say, could create long-term financial challenges for cities and counties.
Real Estate Transfer Taxes
One key focus of the proposal involves real estate transfer taxes—fees imposed when property such as homes, apartments, or commercial buildings is sold. These taxes function similarly to a sales tax on real estate transactions.
Supporters claim that many California cities have increasingly relied on transfer taxes, particularly on high-value properties, as a source of revenue. They argue that these taxes can discourage property sales, reduce market mobility, and place an unfair burden on property owners. The initiative would prohibit new or increased local transfer taxes beyond historical limits tied to the original Proposition 13 framework, effectively reinstating stricter caps.
Who Could Be Affected?
If passed, the measure could benefit property owners, including homeowners, landlords, and commercial real estate investors—especially those involved in high-value transactions. On the other hand, local governments and public agencies may face reduced revenue, which could impact funding for community programs and services.
Ultimately, the debate centers on a fundamental question: should California adopt stricter limits on local taxation, or should local governments retain flexibility to raise revenue to meet community needs?
