One of the most searched questions in California employment law is simple: Can my employer fire me for this? Many employers point to California’s at-will employment rule and act as though that ends the analysis. It does not. While California is an at-will state, employers still cannot engage in wrongful termination, illegal firing, workplace retaliation, or employment discrimination.

Save emails, text messages, letters, performance reviews, write-ups, complaint records, voicemails, meeting invitations, and any HR communications. Keep a timeline of events, including who said what, when it happened, and who witnessed it. In many wrongful termination lawsuits and retaliation claims, documentation makes the difference. A strong record can help expose whether a worker was targeted for engaging in protected activity or asserting their employee rights in California.
