The holidays are something that most people look forward to.  Plans are made for big Thanksgiving and Christmas/Chanukah/Kwanza celebrations.  But the holidays also bring about significant added stress.  Some family law attorneys see a rise in domestic violence restraining orders right around this time.  Domestic violence can be devastating for the entire family.

It can destroy a marriage and have far reaching effects, including serious criminal ramifications.  If you perpetrate domestic violence, you could be looking at having to hire an attorney to represent you in defense of criminal charges, where the initial bail could be $50,000 or more.  You might also have to hire an attorney to represent you in DVPA (Domestic Violence Prevention Act) proceedings, in addition to dissolution or legal separation proceedings.  And the perpetration of domestic violence can affect the court’s decision in making a custody order.  Domestic violence is never the answer.  There is no excuse for physically assaulting your spouse, ever.  Enjoy the holidays and your family.  Don’t forget that these moments are precious.  We wish you a happy holiday from the law offices of Richard A. Marcus.
