How will I Get Paid if I am Unable to Work due to a Work-Related Injury?
What do you do if you have a work-related injury, and cannot perform your job duties because of that injury? An injured worker may be reluctant to treat and recover from a debilitating injury for fear that he or she will not be able to pay the bills or support a family. However, under the California Labor Code, if you are hurt on the job you are entitled to temporary disability benefits. This benefit is a wage loss supplement due to your inability to work as result of your injury. You do not have to use sick or vacation time to support you while you are recovering from the effects of the industrial injury. Under California Law, you are entitled to two-thirds of your average weekly earnings with a maximum payment of $1,067.25 for injuries on or after January 1, 2014. This payment is not subject to taxes. Earnings include: overtime, bonuses and other payments that are part of your work compensation, such as, room and board. Further, earnings are calculated from all sources, including concurrent employment. This benefit is payable when you are not able to do any type of work due to your injury, or if you are able to only do work under modifications or restrictions, but your employer is unable to modify your job while you are recovering from the injury. A medical doctor must certify your disability and this benefit will continue so long as your doctor certifies your temporary disability status. However, for injuries after April 19, 2008, your temporary disability benefits will not exceed 104 weeks. If your claim is not immediately accepted or denied, you can apply for State Disability. However, you cannot receive these benefits simultaneously. This can be daunting and confusing. Make sure you are receiving your rightful benefits and that they are being paid at the correct rate by consulting with a Worker’s Compensation attorney.
