Don’t be Spooked Or Afraid of Speaking with an Attorney!
The reasons vary, but some don’t call an attorney because they are concerned about the costs associated with an injury attorney. Although some attorneys charge clients an hourly rate, personal injury attorney work on a “contingency basis.” This means that there should be no out-of-pocket fees or costs.
Here, at The Mason Law Firm, we only get paid if there is a recovery in the case, whether recovery is by settlement or judgment. Because our fees come directly out of the recovery, there are no out-of-pocket fees. Our fees are simple and there are no hidden fees. If there is ever an unforeseen problem with the case and there is no recovery, you will not owe any fees.
The same principle generally applies to costs. While some attorneys charge “administrative or office costs” associated with making in-house copies, phone calls and faxes, we never charge for such items. The only costs associated with an injury case should be anything related to court filings, obtaining medical records (some facilities charge a fee), and hiring expert witnesses (only if a lawsuit has been filed and with the consent of our client.)
So, there is no reason to be spooked or afraid. If you are ever in an accident, simply (1) Stay calm, and do not argue with the other driver, (2) Exchange names, addresses, driver’s license numbers, and insurance information (better yet – take a picture of the driver’s license and insurance card). (3) If possible, take pictures of the other car. (4) If injured, get checked out by a doctor. Depending on your injuries, you may need to visit the emergency room or urgent care. Thereafter, you may need treatment with a doctor or chiropractor. Remember that getting checked out is not the same as getting treated.
(5) Do not discuss the accident with the insurance company representing the other side without first contacting an attorney. Never give a statement. If you end up speaking with the other insurance company, only discuss your property damage. (6) Never sign authorization forms provided by an insurance company. (7) Call us – your SCV personal injury attorney. This is the best way to protect yourself.
