From clients and prospective clients, we sometimes hear: “I was told that my case is worth …”; or “I did a Google search and found out that these types of cases settle for …”
First rule when contemplating the value of a case is never, ever take advice from anyone aside from your attorney, not from Google, not from friends, and not from relatives, particularly when they tell you that “someone they know got a million dollars for an injured hangnail!”
The best person who can advise you on such matters is your attorney because he or she knows the true facts and nuances of your case, knows the true nature of your injuries, knows all the pitfalls, and has been in contact with the adjuster or the defense attorney. Your attorney will take into account a variety of factors when determining the value of your case, including:
(1) Timing – at what point in the case is this question asked? Before or after you finished treatment?
(2) Type of case – is it a car accident with clear liability, a slip and fall with disputed liability, or some other type of case? If liability is an issue, it will impact the case value.
(3) Type of injury – did you sustain soft tissue injury (whiplash), break a bone, something more serious? Different types of injuries yield different results.
(4) Amount of medical bills – were bills paid by private insurance, Medicare/MediCal, or are the bills on liens? The amount of medical bills impacts the case value.
(5) What insurance company is involved? Different insurance companies and adjusters handle claims differently, and in doing so, pay different amounts.
(6) Current economic climate – yes, what goes in the world changes the way insurance companies handle claims.
