Dissolving Marriages in Accordance with Jewish Law in Los Angeles – Lite Family Law
In the Jewish tradition, a religious divorce, known as a Get, is required in addition to a civil divorce in order to dissolve a marriage. Obtaining a Get can be a complex and emotional process, but it is an important step for couples who wish to fully end their marriage in accordance with Jewish law. In Los Angeles, couples can obtain a Get through the Los Angeles Rabbinical Court.
First, the couple must initiate the process by filing a request for a Get with the Rabbinical Court. This request can be filed by either spouse, or by a representative if one of the spouses cannot appear in person. Once the request for a Get has been filed, the Rabbinical Court will schedule a hearing for the couple. At this hearing, both spouses will be asked to appear before a panel of three rabbis to discuss the reasons for the divorce and to provide testimony regarding the dissolution of the marriage. The rabbis will then review the evidence and make a determination as to whether a Get should be issued.
If the rabbis determine that a Get should be issued, they will prepare a document known as a sefer k’ritut, which officially dissolves the marriage in accordance with Jewish law. This document is then presented to the husband, who must deliver it to his wife in the presence of two witnesses. Once the Get has been delivered, the couple is considered fully divorced in accordance with Jewish law.
It is important to note that obtaining a Get is a separate process from obtaining a civil divorce. In California, couples must obtain a civil divorce through the Los Angeles Superior Court in order to legally dissolve their marriage. However, obtaining a civil divorce does not necessarily mean that the couple is also divorced in accordance with Jewish law.
In addition to the emotional and spiritual benefits of obtaining a Get, there are also practical considerations to consider. For example, without a Get, a woman may be unable to remarry in the Jewish tradition. Additionally, if a woman remarries without obtaining a Get, any children born from the subsequent marriage may be considered illegitimate in the eyes of Jewish law.
While obtaining a Get can be a complex process, there are resources available to help couples navigate the process. The Los Angeles Rabbinical Court, for example, provides guidance and support to couples seeking a Get. Additionally, couples may wish to consult with an experienced family law attorney who is familiar with the process of obtaining a Get.
