One key benefit of Chapter 13 is that it can help homeowners facing foreclosure keep their homes. If you have a second mortgage with no equity securing it—common in today’s housing market—you might qualify for a “lien strip,” where the second mortgage is removed from the property. This can significantly reduce mortgage payments and make keeping your home more affordable. Chapter 13 can include a wide range of debts, including credit card bills, personal loans, medical expenses, back taxes, and even student loans.
Immediate Relief from Creditors
Whether you file for Chapter 7 or Chapter 13, filing your petition triggers an automatic stay. This legal protection halts creditors from pursuing or continuing collection actions, such as lawsuits, wage garnishments, repossessions, and foreclosure.
