Out of Debt: Eliminate or Consolidate – When Filing Bankruptcy Makes Sense – Ray J. Bulaon
When other options for debt relief have been exhausted, bankruptcy can be a lifeline for many individuals. Fortunately, the stigma surrounding bankruptcy has diminished, and people who file often rebuild their credit successfully in just a few years. However, filing for bankruptcy is a serious decision and should be made with the guidance of an experienced attorney. If done properly, it can be a crucial step in overcoming financial struggles.
There are two main types of bankruptcy for individuals: Chapter 7 and Chapter 13. Each offers unique benefits depending on your financial situation.
Chapter 7 Bankruptcy
Chapter 7 allows individuals to discharge most unsecured debts they can no longer afford to pay, such as credit card balances, personal loans, and medical bills. Certain debts, like student loans, most taxes, and child support, are generally not discharged. When you file for Chapter 7, a bankruptcy trustee may sell non-exempt assets to pay creditors. However, in most cases, exemption laws protect your assets, meaning you likely won’t lose anything. For example, in nearly all cases handled by my office, clients retain their property and assets. They lose nothing but their debts.
Chapter 13 Bankruptcy
Chapter 13 bankruptcy is a repayment plan that consolidates all your debts into a single monthly payment. You can pay creditors partially or in full over a 3–5-year period. One key benefit of Chapter 13 is that it can help homeowners facing foreclosure keep their homes. If you have a second mortgage with no equity securing it—common in today’s housing market—you might qualify for a “lien strip,” where the second mortgage is removed from the property. This can significantly reduce mortgage payments and make keeping your home more affordable. Chapter 13 can include a wide range of debts, including credit card bills, personal loans, medical expenses, back taxes, and even student loans.
Immediate Relief from Creditors
Whether you file for Chapter 7 or Chapter 13, filing your petition triggers an automatic stay. This legal protection halts creditors from pursuing or continuing collection actions, such as lawsuits, wage garnishments, repossessions, and foreclosure. The immediate relief can provide much-needed peace of mind and breathing room to get your financial situation back on track.
Is Bankruptcy Right for You?
If you’re struggling with debt and unsure about your next step, consulting a bankruptcy attorney is essential. A knowledgeable attorney can assess your unique situation and help you determine whether bankruptcy is the best course of action. Bankruptcy can offer a fresh start, but it is vital to weigh the pros and cons based on your individual circumstances.
In conclusion, while bankruptcy is a significant decision, it can be the most effective solution for overcoming insurmountable debt. With the right legal assistance, it can provide a clear path to financial recovery and allows you to move forward with confidence.
