Social media can be a great way to connect and build community, but if you are in a divorce or custody matter, it’s important to be mindful of what you post online about the other parent and your case. In family law matters, your comments and communication will be scrutinized by not only your friends and followers, but by your ex, your respective attorneys and can go in front of a judge, custody evaluator and more.
Generally speaking, parents should avoid saying anything disparaging about the other party, both in conversation in front of their children and online. It can be tempting to vent online about your co-parent but that can end up hurting you and your children more. The last thing you want is to tell the judge you’re trying your best to promote a good relationship with the other parent and then be put on blast in the court room for calling them a clown or cheap etc. and risk harming your case. There’s a difference between sharing your “truth” vs disparaging the other parent!
In instances where posts and comments have crossed the line, parties have been issued warnings. However, those who choose not to comply with the judge’s warning could find themselves ordered to pay monetary sanctions for their online activity or even face repercussions that may change their custodial time or decision-making ability for their minor children.
An important reminder, just because you post on your stories and think it may disappear, doesn’t mean it’s gone forever. Additionally, deleting posts isn’t a good look either as it can be interpreted as destroying evidence. Even burner accounts can be tracked down by an opposing party or counsel, so it is best practice to avoid posting anything negative about the other parent online and seek legal advice before going live.
