Understanding California’s “Date of Separation” in Divorce Cases – Dacorsi Placencio P.C.
One of the most important issues in a California divorce case is determining the “date of separation.” This date can significantly affect how property, income, debts, and support are divided between spouses. Under California Family Code section 70, the date of separation occurs when one spouse expresses to the other that the marriage is over and their conduct is consistent with that intent.
Why does this matter so much? California is a community property state. Generally, assets and debts acquired during the marriage belong equally to both spouses. However, once the parties separate, income earned and debts incurred afterward may become separate property. A disagreement over the separation date can therefore involve hundreds of thousands—or even millions—of dollars.
For years, California courts sometimes recognized “living separate and apart” even if spouses remained under the same roof. Then came the California Supreme Court case In re Marriage of Davis in 2015, which temporarily held that spouses had to live in separate residences to establish separation. That ruling created problems for couples who could not afford separate homes or stayed together temporarily for their children.
In response, California lawmakers enacted Family Code section 70, which clarified that spouses can be considered separated even while living in the same home. Courts now look at the totality of the circumstances, including whether spouses stopped sharing finances, stopped wearing wedding rings, slept separately, or informed friends and family of the breakup.
The issue frequently arises in high-asset divorce cases involving stock options, business income, bonuses, or real estate appreciation. For example, if a spouse earns a large year-end bonus after separation, the court may need to determine whether it is community or separate property. The same analysis applies to debts, retirement contributions, and investment gains.
Evidence in separation-date disputes often includes text messages, emails, therapy records, financial statements, and testimony from family members. Because the issue is so fact-specific, courts carefully analyze both the spouses’ words and actions.
Understanding the date of separation is critical for anyone considering divorce in California. A mistaken assumption about when separation occurred can have major financial consequences. Consulting an experienced California family law attorney early in the process can help protect important property rights and prevent costly disputes later in the case.
