Will Your Kids Know What To Do When That Time Comes? – Thompson Von Tungeln
Even if you have an expertly drafted estate plan, things can go very wrong very quickly if your Successor Trustee, the person you have entrusted to take care of you when you are sick and to administer your estate after you have passed away, does not understand 1) how your trust works, 2) what their responsibilities are and 3) important issues and risks to avoid. Your Successor Trustee’s mistakes could result in significant risks, liabilities and losses for you, your estate, your beneficiaries and even your Successor Trustee.
Specifically, a Successor Trustee plays a critical role in managing and distributing assets according to the terms of your trust. Their actions not only impact you but also the beneficiaries who rely on the trustee for proper asset management. Your Successor Trustee needs to carry out your instructions outlined in your trust including paying debts, filing taxes, and managing or distributing assets to beneficiaries. If the Successor Trustee is unprepared, misunderstandings could lead to delayed distributions, incorrect tax filings, or even disputes with beneficiaries, jeopardizing the trust’s purpose.
For beneficiaries, the successor trustee ensures fair and timely distributions, protecting their inheritance and avoiding mismanagement of trust assets. A lack of transparency or financial oversight can damage family relationships and lead to legal challenges, especially if beneficiaries suspect the trustee is acting improperly. Common red flags include conflicts of interest, incomplete documentation, and failing to communicate effectively with beneficiaries and could result in litigation or penalties.
If you have a trust, we strongly encourage you and your Successor Trustee and family to attend our Free Successor Trustee Seminar on Saturday November 9th at the Hyatt Regency Valencia. Seating is very limited so please call us at (661) 945-5868 at your earliest convenience to reserve your seats or to book a free initial consultation.
