In 2026, California couples have a new option for ending their marriage or domestic partnership: the Joint Petition for Dissolution. This new procedure is designed to streamline the divorce process, reducing cost, conflict, and unnecessary public disclosure.
The Joint Petition is not the same as California’s existing Joint Petition for Summary Dissolution. Summary Dissolution remains available, but it is limited to couples who meet strict eligibility requirements regarding the length of marriage, property, debt, and the absence of children. Many couples simply do not qualify. The new Joint Petition removes those barriers for couples who agree to divorce and who are committed to resolving all issues by agreement rather than litigation.
One of the most immediate benefits is cost savings. In a traditional divorce, each party must typically pay a $435 filing fee. Under the Joint Petition process, only one $435 filing fee is required. Just as important is the privacy advantage. In California, divorce filings are public records. The Joint Petition allows parties to address sensitive matters, such as support or financial arrangements, privately in a settlement agreement rather than in public pleadings.
